List of the main criteria that must be met by a subject of valuation activity (hereinafter, SVA) for their approval (recommendation) at JSC CREDIT AGRICOLE BANK (hereinafter, the Bank):
The SVA (appraisers) intending to cooperate with JSC CREDIT AGRICOLE BANK in the field of property and property rights valuation must meet the criteria set out in the Law of Ukraine ‘On Valuation of Property, Property Rights and Professional Valuation Activities in Ukraine’, by the National Bank of Ukraine, as well as the requirements of JSC CREDIT AGRICOLE BANK.
As applicants for cooperation, SVAs must meet the following requirements:
1. They must be registered in Ukraine in accordance with the current legislation as business entities – private entrepreneurs, as well as legal entities regardless of their organisational and legal form and form of ownership, which carry out economic activities, and must be included in the State Register of Appraisers and Appraisal Entities;
2. They must have a valid certificate to carry out property valuation activities in the following areas of specialisation (1.1, 1.2, 1.3, 2.1 – mandatory, 1.7 – desirable):
- Specialisation 1.1. "Valuation of immovable items (immovable property, real estate), including expert monetary valuation of land plots;
- Specialisation 1.2. "Valuation of machinery and equipment;
- Specialisation 1.3. "Valuation of road vehicles;
- Specialisation 1.7. "Valuation of movable property, other than machinery, equipment, motor vehicles, aircraft, ships and those of cultural value;
- Specialisation 2.1. ‘Valuation of integral property complexes, shares, securities, property rights and intangible assets (except for the valuation of rights to intellectual property)’;
3. The certificate issued in the name of the SVA must be valid for the period of validity specified therein at the time of submission of documents to the Bank, and the SVA must be included in the State Register of Appraisers and Appraisal Entities;
4. Not to be in the process of bankruptcy, reorganisation, liquidation, or suspension of activities;
5. The experience of practical activity of the SVA in the Ukrainian market for property valuation is at least five years, of which at least three years in the areas of property valuation of certain types of collateral;
6. Practical experience of appraisers performing valuation as part of the SVA for at least two years, of which at least one year in the areas of property valuation of certain types of collateral;
7. No information about the SVA and appraisers performing the appraisal committing violations of regulatory legal acts on the valuation of property, property rights and professional valuation activities in Ukraine; facts of violations of restrictions on property valuation established by the law of Ukraine; reviews of the property valuation report, which is classified according to the following criteria: the property valuation report does not meet the requirements of regulatory legal acts on valuation in the State Property Fund of Ukraine for the last three years preceding the date on which the SVA is considered;
8. No information from the National Bank of Ukraine that the National Bank has not reviewed the property valuation report in the last three years preceding the date of its submission, which is classified according to the following criteria: the property valuation report does not meet the requirements of regulatory legal acts on property valuation, is of poor quality and (or) unprofessional and cannot be used;
9. The SVA and appraisers performing the appraisal as part of the SVA should not be connected to the bank (affiliated, related, associated) within the meaning of Article 52 of the Law of Ukraine ‘On Banks and Banking’;
10. Priority shall be given to the SVAs that have a network of branches in the regions of Ukraine and those that have appraisers for expert monetary valuation of land plots and are registered in the State Register of Certified Land Surveyors, as well as to the SVAs with the maximum number of specialisations in accordance with the certificate in the areas specified in clause 4.1.2 of the Procedure.
If an SVA that applies for cooperation does not meet at least one of the requirements specified in clauses 1-10, the Bank shall not accept the documents for consideration.
The first step in the process of considering an SVA as a partner for cooperation is to submit an application to the Bank in any form, initiated by the SVA, with a general summary containing the main characteristics of the SVA:
- certification by areas;
- main counterparties;
- letters of recommendation from banking institutions;
- market experience;
- character references from partners;
- tariff plan;
- regional network;
- membership in SRO;
- other pertinent information about the company, in the opinion of the SVA.
In case of a positive preliminary conclusion, the Bank informs the SVA applying for cooperation about the possibility of considering such SVA as a partner valuation company during the annual review of the SVA.
Base document package required for consideration of SVA as a partner and conclusion of a cooperation agreement (copies)
1. Application form from the SVA for cooperation between the SVA and the Bank (sample upon request)
2.Certificate of the appraiser (SVA).
3. Qualification certificates of appraisers employed by the SVA and whose data are submitted to the State Property Fund of Ukraine when applying for a certificate of the appraiser; certificates of advanced training of such appraisers, if necessary (as required by the legislation of Ukraine).
4. Constituent documents (charter).
5. A document certifying the state registration of the SVA (Statement or Extract from the Unified State Register of Legal Entities and Individual Entrepreneurs or other document established by law).
6. Minutes of the meeting of participants (shareholders), order, power of attorney (if provided for in the charter of the SVA), other document confirming the powers of the director of the SVA or the person who will sign the cooperation agreement with the Bank.
7. Certificate of VAT payer (or extract from the register of VAT payers) / certificate of single tax payer (or extract from the register of single tax payers).
8. Tariffs for the services of the SVA with the terms of the appraisal and information about the branch network (address, contact person, telephone, e-mail, etc.).
9. Spreadsheet of data on appraisers' documents and certificates of the SVA.
10. A copy of the TIN and passport of the director (manager) and ultimate beneficial owners.
11. Samples of property valuation reports: one property valuation report for each specialisation specified in the SVA Certificate (for Specialisation 1.1, one report on residential and commercial real estate valuation is required)
If necessary, the Bank has the right to request any other documents, this list may be amended or supplemented in view of the current market situation and changes in legislation/local requirements.
The submission of a request for cooperation and a package of documents to the SVA does not guarantee that the Bank will make a positive decision on cooperation with the SVA.
The Bank reserves the right to refuse to cooperate without giving any reason.
